Juan's story begins with tragedy. He was born in El Salvador, a country where violence claims lives daily. When Juan was just a small child, his father was murdered - a victim of the violence that plagues the region. This loss would shape the course of Juan's young life.
After his father's death, Juan's mother brought him to the United States, seeking safety and a chance to raise her son without the constant threat of violence. They settled in New York, where Juan began to build a new life far from the dangers of El Salvador.
For a child so young, Juan faced challenges he couldn't fully understand. He had lost his father to violence and was living in a new country with an uncertain immigration status. His mother worked hard to provide for him while navigating the complex immigration system.
Juan's case was handled in Bronx Family Court, where the judge recognized a crucial legal principle: in New York, the death of a parent can constitute 'constructive abandonment' for SIJS purposes. The court determined that it was in Juan's best interest to remain in the United States, where he was safe and could have opportunities unavailable in El Salvador.
USCIS approved Juan's SIJS petition in 2018, securing his ability to remain in the United States. At just 5 years old, Juan received protection that would shape the rest of his life. He would grow up American, with all the opportunities that entails.
Today, Juan is growing up in a safe environment with his mother. He attends school, plays with friends, and lives the normal childhood that was impossible in El Salvador. He may not fully understand yet what his immigration status means, but he knows he is safe and loved.
